1.                The PROMOTION: The following terms and conditions set out how you can win a night in York or Warsaw by posting a photograph through social media of a design aspect from your home that represents your neighbourhood. By entering the Promotion, the entrant agrees to be unconditionally bound by these terms and conditions.

2.                The Promoter: the promoter of this Promotion is IHG Hotels Limited of Broadwater Park, Denham, Buckinghamshire, UB9 5HR, England. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or Instagram.

3.                Eligibility and limitations:

3.1             The Promotion is only open to all legal residents in the United Kingdom aged 18 years or over. Those under the age of 18 cannot participate in the Promotion and even if they do participate and win, they will not be awarded the Prize. The Promotion is NOT open to:

3.1.1                   employees of the Promoter or its holding or subsidiary companies or employees of any franchised, managed or owned IHG hotels or

3.1.2                   employees of agents or suppliers of the Promoter or its holding or subsidiary companies or its franchised, managed or owned IHG hotels, who are professionally connected with the Promotion or its administration; or

3.1.3                   members of the immediate families or households of 3.1.1 and 3.1.2 above.

3.2             A Facebook, Twitter or Instagram account is required for entry  and the Entrant may be required to show proof that the registration of Facebook, Twitter or Instagram account occurred before the beginning of the competition.

3.3             In entering the Promotion, you confirm that you are eligible to do so and eligible to claim any Prize you may win. The Promoter may require you to provide proof that you are eligible to enter the Promotion and/ or claim any Prize you may win.

3.4             Entry Limitations – The following entry limitations apply:

3.4.1                   The Promoter will not accept entries that are: automatically generated by computer; completed by third parties; completed in bulk; incomplete; illegible; altered, reconstructed, forged or tampered with; or photocopies and not original;

3.4.2                   There is a limit of one entry to the Promotion per household.

3.4.3                   Entries on behalf of another person will not be accepted. Entrants must be the owner of the social media account from which they post the photograph. In the event of a dispute as to any registration or entry, the authorized account holder of the social media account used to enter will be deemed to be the entrant.  The potential winner may be required to show proof of being the authorized account holder for the social media account.

3.4.4                   The Promoter reserves all rights to disqualify you if your conduct is contrary to these T&Cs or otherwise the spirit or intention of the Promotion.

3.4.5                   The Promoter reserves the right to remove any offensive, infringing or inappropriate posts and to exclude those responsible for such posts from the Promotion.

3.4.6                   There are Prize limitations and these are set down in condition 7.

4.                Starting date and closing date

4.1             The Promotion begins on 14 September 2017 at 0.01am Greenwich Mean Time (“GMT“) (“Opening Date“) and ends on 15 October 2017 at 11.59pm GMT (“Closing Date“).  The Winner(s) will be announced on the Announcement Date as defined in clause 9.1.

4.2             All entries must be received by the Promoter in accordance with the entry process as set down in condition 5 by no later than 11.59pm on the Closing Date. All entries received after the Closing Date are automatically disqualified.

5.                How to Enter

5.1             To enter the Promotion:

5.1.1                   Post a photograph through Facebook, Twitter or Instagram of a design aspect from your home that represents your neighbourhood.

5.1.2                   Facebook participants will enter by posting a photograph in the comments section o the post, # and @ must be included.

5.1.3                   Instagram participants can enter by posting an image and tagging Hotel Indigo Instagram account,# and @ must be included.

5.1.4                   Twitter participants can enter by posting a picture and # and tagging @Hotel Indigo twitter account.

5.2             No purchase necessary and there is no charge to register for use of the Promoter’s website.

5.3             The Promoter will not accept:

5.3.1                   entries that are incomplete, late, or otherwise defective, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind;

5.3.2                   the sharing of a Promotion post on any personal timelines as an entry into the Promotion.

6.                Prize

6.1             The prizes will be awarded to two Winners (“Winner“). The number of prizes is two. One Winner will be awarded one night stay in York Hotel Indigo and the other winner will be awarded one night stay in Warsaw Hotel Indigo. (each a “Prize“, together the “Prizes“). The ability of a Winner to use a Prize will be subject to meeting the conditions included below in condition 7.

6.2             The Prize is not negotiable or transferable. Prizes are subject to availability. There is no cash alternative for the Prize save that the Promoter reserves the right to substitute the Prize with a Prize of equal or greater value.

6.3              The Prize is supplied by InterContinental Hotels Group (the “Supplier“)].

6.4             Each Prize is for a maximum two people to stay for one night between October 14, 2017 and December 31, 2017 (excluding Saturday nights) in Hotel Indigo York or between October 14, 2017 and March 31, 2018 at Hotel Indigo Warsaw – Nowy Swiat.

6.5             The Prize does not include travel to and from the hotel including but not limited to any flight, rail or transfer costs to and from airports or stations, travel insurance, food and drink [other than breakfast at the hotel], spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the Prize are the responsibility of the Winners. The Promoter will be responsible for any sales tax due in respect of any good or service awarded as a Prize to a Winner but the Winner shall otherwise be responsible for any other applicable taxes.

6.6             You will be responsible for ensuring that you and any person travelling with you are available to travel and where appropriate hold valid passports, any necessary visas and travel documents to get to the hotel in question on the dates specified. [Dates once notified to the Promoter/travel agent cannot be changed.

7.                Prize conditions

7.1             In order to be eligible to take up the Prize, the Winner must:

8.                Selection of Winners

8.1              Within 5 days of the Closing Date, the entries will be judged by a panel of 3 judges based on the quality of the photo, how local the design is and how representative it is of the neighbourhood. The decision of the panel of judges (acting reasonably) will be final.

8.2             The Promoter will send the full names of the judges to anyone who writes within one month of the Closing Date of the Competition requesting details of the judges and who encloses a self-addressed envelope to the address set out in condition.

9.                Winner announcement

9.1             The Winner of the Promotion will be announced on the competition page at on October 17, 2017 (“Announcement Date“).

9.2             The decision of the judges nominated by the Promoter is final and no correspondence or discussion will be entered into.

9.3             Except to the extent that the Promoter is prevented by law from doing so, the Promoter will send the name and town/city of residence of the Winner to anyone who writes within one month after the Closing Date requesting details of the Winner and who encloses a self-addressed envelope to the address set out in condition 1.

10.             Claiming the Prize

10.1          The Winner will be notified via a private inbox message and a public message on Facebook, Twitter or Instagram on or before 1 October 2017. The Winner must, within 7 days of being notified as the Winner, confirm to the Promoter by return Facebook message that he/she wishes to accept the Prize.

10.2          If the Winner cannot be contacted or is not available, or has not claimed their Prize within seven (7) days of the Announcement Date, the Promoter reserves the right to offer the Prize to the next eligible entrant selected. according to the criteria set out in the “Selection of Winners” clause above in place of the Winner that cannot be contacted.

10.3          The Prize may not be claimed by a third party on a Winner’s behalf. The Promoter does not accept any responsibility if a Winner is not able to take up the Prize.

11.             Limitations on liability

11.1          By accepting a Prize, the Winner agrees to release and hold harmless the Promoter and its subsidiaries, affiliates, suppliers, distributors, agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, damage to or loss of property, arising out of participation in the Promotion or receipt of, use or misuse of any Prize.

11.2          The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software failures of any kind including any injury or damage to any person’s computer account resulting from participating in this Promotion, or mistranscribed data; (3) unauthorized human intervention or human error which may occur in any part of the entry process or the process for allocating the prize(s); (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; (5) late, lost, undeliverable, damaged or stolen post; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any Prize.  If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion, if it is possible.

11.3          Nothing in this section shall exclude the Released Parties’ liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability whose limitation is prohibited by law.

11.4          Paragraphs 11.1 to 11.3 apply to German entrants only subject to the following restrictions: Irrespective of the legal basis, the statutory liability of the Released Parties for gross negligent or intentional behaviour, including the failure to act, is not limited. In case of breach of material contractual obligations, i.e. such obligations whose fulfilment only enable the performance of the contract and whose observance the Customer may generally trust in (so called “cardinal duties”), the liability of the Released Parties is limited to damages which are typical and foreseeable at the time of conclusion of the contract. The Released Parties’ liability for damage to life, body or health or its mandatory liability under the German Product Liability Act, as well as due to representations and guarantees remains unaffected hereby. In all other cases the Released Parties’ liability is excluded.

11.5          Facebook AND Twitter AND Instagram may not be held liable for any claim arising from an Entrant’s participation in the Promotion or taking up a Prize.

12.             Ownership of entries and intellectual property rights

12.1          All entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt.

12.2          By submitting your entry and any accompanying material, you agree to, so far as permitted by law:

12.2.1                assign to the Promoter all your intellectual property rights in full with full title guarantee and execute any such documents and perform such acts as may be required for the purpose of giving full effect to this clause 12

12.2.2                waive all moral rights, in and to your entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the UK Copyright, Designs and Patents Act 1988 and local equivalent laws and statutes as amended from time to time and under all similar legislation from time to time in force anywhere in the world. This clause shall not apply to German entrants.

12.3          You agree that the Promoter may, but is not required to, make your entry [and your photo] available on its website [WEBSITE], its social media pages, and any other media, whether now known or invented in the future, and in connection with any publicity of the Promotion.

12.4          You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights and moral rights in the entry and any accompanying materials which you are unable to assign, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the entry and any accompanying materials for such purposes.

13.             Data protection

13.1          By entering the Promotion, you agree that the Promoter or its agents and suppliers may use:

13.1.1                any personal data provided by you with your entry to administer the Promotion; and

13.1.2                your name, image and town and/ or county of residence if you are the Winner (and except where prohibited) to announce the Winner.

13.1.3                you have the right to object, for a legitimate purpose, to the collection of your personal data, a right to access the collected data and a right to have the processed data rectified, completed, blocked or deleted. Certain personal data are necessary to administer the Promotion. If you exercise your right to object to the processing of such personal data prior to the end of the Promotion, your participation will be cancelled.

13.2          All personal data submitted to the Promoter as part of this Promotion will be treated in accordance with the Promoter’s privacy policy, available at

14.2          If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion for the safe and fair development of the Promotion, reserve the right to exclude you from participating in the Promotion.

14.3          The Promoter reserves the right to hold void, suspend, cancel, or amend the Promotion where it becomes necessary to do so.

14.4          These terms and conditions shall be governed by English law. This choice of law does not deprive you of the protection afforded to you under your own laws and such provisions that cannot be derogated from by agreement by virtue of the law of your jurisdiction. The parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

14.5          If any provision(s) of these Terms and Conditions (or any part thereof) are held to be invalid or unenforceable, all remaining provisions (or any part thereof) hereof will remain in full force and effect.
